Overview
Our affiliates are important to us, and we want the relationship to be fair, transparent, and useful for everyone involved. By applying to or participating in the Musicvertising affiliate program, you agree to follow this Affiliate Agreement and any program rules provided through our affiliate platform or team.
In this agreement, Musicvertising, we, us, and our refer to Musicvertising. You and your refer to the affiliate, publisher, partner, agency, creator, website owner, or marketer participating in the program.
Program Purpose
The affiliate program allows approved affiliates to refer customers to Musicvertising using authorized tracking links, banners, coupons, landing pages, and other approved promotional materials.
Affiliates are independent promoters. Participation in the program does not create a joint venture, partnership, franchise, agency, employment relationship, or authority to act on behalf of Musicvertising.
Enrollment And Approval
To participate, you must submit an affiliate application through the affiliate platform or another process we provide. We may approve, reject, review, pause, or remove any affiliate at our discretion.
Approval into the program does not prevent us from later reviewing your website, traffic sources, promotional methods, compliance, or account activity.
Affiliate Responsibilities
You are responsible for keeping your website, social profiles, ads, emails, content, disclosures, and promotional materials accurate, lawful, current, and compliant with this agreement.
You must use the links, tracking codes, banners, coupons, and other materials provided or approved by us so referrals can be tracked accurately.
You are responsible for your own taxes, business expenses, website costs, advertising costs, compliance obligations, and business records.
FTC And Disclosure Requirements
You must clearly and conspicuously disclose your affiliate relationship with Musicvertising whenever you promote our services, publish reviews, share testimonials, recommend offers, post affiliate links, or create content where you may earn compensation.
You are responsible for complying with Federal Trade Commission endorsement guidelines, advertising rules, email marketing laws, privacy laws, platform rules, and any other laws that apply to your promotions.
Prohibited Content
You may not participate in the program or promote Musicvertising from websites, accounts, ads, emails, or content that promotes illegal activity, sexually explicit material, violence, hate, discrimination, harassment, scams, malware, deceptive claims, or content that infringes intellectual property rights.
We may reject or remove an affiliate if we determine that the affiliate, website, traffic source, or promotional method is unsuitable for the Musicvertising brand.
Brand And Website Restrictions
You may not create websites, ads, landing pages, social profiles, emails, or other materials that imitate Musicvertising, appear to be operated by Musicvertising, or mislead users into believing you are Musicvertising.
You may not register domains, usernames, handles, search ads, or other properties that use Musicvertising, misspellings of Musicvertising, or confusingly similar brand terms without written permission.
Paid Search And Advertising Restrictions
Paid search campaigns that bid on Musicvertising, Musicvertising.com, our brand terms, or confusingly similar variations are prohibited unless we give written permission.
You may not run ads that misrepresent pricing, discounts, guarantees, campaign results, platform affiliation, or any claim about our services.
Email, Spam, And Direct Outreach
Spam is prohibited. You may not use unsolicited commercial email, misleading sender information, deceptive subject lines, scraped contact lists, fake opt ins, or any outreach method that violates applicable law or platform rules.
If you promote Musicvertising by email, you must have permission to contact the recipient, clearly identify yourself, include required disclosures, and provide a working unsubscribe method where required.
Software And Tracking Restrictions
We do not work with affiliates who use downloadable software, toolbars, browser helper objects, shopping assistance applications, cookie stuffing, forced redirects, hidden iframes, pop unders, deceptive pop ups, or other methods that interfere with fair affiliate tracking.
You may not overwrite, replace, block, hijack, or manipulate affiliate cookies or tracking links through deceptive or automated methods.
Commissions
Commission rates, eligible products, attribution windows, payment timing, payout methods, minimum payout thresholds, and program rules may be shown in the affiliate platform or in written communications from us.
Unless stated otherwise in writing, commissions are earned only on valid, tracked, approved purchases from eligible customers that are not refunded, charged back, fraudulent, self referred, duplicated, canceled, or otherwise disqualified.
Payments
Affiliate tracking and payments may be handled by a third party affiliate platform or payment provider. You are responsible for keeping your account, tax, contact, and payout information accurate and current.
Payments may be delayed, adjusted, reversed, or withheld if a transaction is refunded, charged back, disputed, fraudulent, suspicious, incorrectly tracked, ineligible, or in violation of this agreement.
Fraud And Abuse
Fraud, abuse, misleading promotion, fake referrals, stolen payment methods, self dealing, unauthorized coupon use, cookie manipulation, fake leads, incentivized abuse, or any attempt to game the program is prohibited.
If fraud or abuse is detected, we may terminate your account, reverse commissions, withhold unpaid balances, remove tracking access, and take any other action available to us.
Use Of Licensed Materials
While you remain an approved affiliate in good standing, we grant you a limited, nonexclusive, revocable, nontransferable permission to use approved Musicvertising links, banners, logos, trade names, and promotional materials only for the purpose of promoting Musicvertising under this agreement.
You may not alter our brand assets, use them in a misleading way, suggest sponsorship or endorsement beyond the affiliate relationship, or continue using them after your participation ends.
Musicvertising Rights
We may monitor your website, ads, content, traffic sources, affiliate links, coupon use, and promotional methods to determine whether you are complying with this agreement.
We may request changes to your promotional materials or methods. If you do not make requested changes, we may pause or terminate your participation in the affiliate program.
Confidentiality
You agree to keep confidential any nonpublic business, technical, financial, customer, campaign, commission, or program information we share with you, unless we give written permission to disclose it.
Termination
Either party may end the affiliate relationship at any time, with or without cause, by written notice. We may terminate the relationship immediately if you breach this agreement, commit fraud, abuse the program, violate law, or create risk for Musicvertising.
After termination, you must stop using Musicvertising affiliate links, tracking codes, coupons, brand assets, and promotional materials.
Modification
We may update this Affiliate Agreement or the affiliate program rules at any time. Your continued participation after changes are posted or provided means that you accept the updated terms.
Disclaimer
We do not guarantee uninterrupted operation of the website, affiliate platform, tracking systems, payment systems, or program. We do not guarantee that you will earn any specific commission amount, income level, conversion rate, or business result.
Limitation Of Liability
To the maximum extent permitted by law, Musicvertising will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages related to this agreement or the affiliate program, including lost revenue, lost profits, lost commissions, lost data, goodwill, or business interruption.
Indemnification
You agree to indemnify and hold Musicvertising harmless from claims, losses, damages, liabilities, costs, and expenses arising from your website, content, ads, email, traffic sources, promotional methods, breach of this agreement, violation of law, or violation of third party rights.
Governing Law
This Affiliate Agreement is governed by the laws of the state of Florida, USA, without regard to conflict of law principles.
